Parties. This Firearm Consignment Agreement (“Contract”) is between KILO 1 SIX ARMS, a federally licensed firearms dealer, FFL 1-63-10943, Spruce Pine, Alabama (“Dealer”), and the person named in the Consignor Information section of this form (“Consignor”). Consignor places the firearm(s) listed on this form with Dealer for sale on consignment under these terms.

Consignor certification. Consignor certifies that Consignor (a) is the lawful owner of each firearm listed, or is legally authorized to sell it; (b) is not prohibited by federal, Alabama, or other law from possessing, receiving, or transferring firearms; (c) the firearms are not stolen, are free of liens and claims, and have not had serial numbers altered or removed; and (d) the information on this Contract is true and complete. Consignor agrees to notify Dealer immediately if any of these statements becomes untrue.

Fees and payout (per firearm). Intake fee per firearm: $25.00, non-refundable, paid at checkout when you submit this form. Pay by card online, or choose "Pay in cash at store" at checkout and pay in cash at our counter. Sale fee per firearm: $75.00, due when that firearm sells (deducted from its sale price). Total dealer fees per firearm: $100.00. Example: 2 firearms = $50.00 due at intake. Each intake fee is non-refundable whether or not that firearm sells. The $75.00 sale fee applies only to a firearm that sells.

Each firearm’s payout = its sale price minus $100.00 in fees, and minus any taxes, shipping costs (including cases and boxes), and insurance for that firearm. The fees above do not include taxes, shipping, or insurance; those amounts are deducted from that firearm’s payout or paid separately by Consignor, as recorded on the official in-store copy.

Price negotiation. If Consignor checks the negotiation box on this form, Consignor authorizes Dealer to negotiate the sale price with buyers, at or above the Minimum Price listed for each firearm. If unchecked, Dealer will sell only at the Asking Price unless Consignor approves a lower price in writing (text or email is acceptable).

5.1  Consignment period. This consignment runs for 90 days from the Agreement Date. At the end of the period Consignor will pick up the unsold firearm(s), renew for another period, or reduce the asking price, as recorded on the official in-store copy. Dealer will contact Consignor before the period ends. Any firearm returned to Consignor is subject to Section 5.6 (background check before return).

5.2  A&D bound book. Each consigned firearm will be logged into Dealer’s federal Acquisition & Disposition (A&D) bound book upon receipt and disposed of in the bound book when sold or returned, as required by federal law.

5.3  Background checks. Every sale is made only through ATF Form 4473 and a NICS background check (or other lawful transfer procedure), in compliance with federal law and the laws of the State of Alabama.

5.4  Payout timing. Dealer will pay Consignor within 7 business days after the sale clears (buyer’s funds collected and transfer completed).

5.5  Payout method. Cash, check, or store credit, as selected by Consignor on this form.

5.6  Withdrawal before sale. Consignor may withdraw a firearm before it sells. That firearm’s $25.00 intake fee is not refunded. Because the firearm is in Dealer’s licensed inventory, it will be returned only after Consignor completes ATF Form 4473 and passes a NICS background check.

5.7  Care and liability. Dealer will store consigned firearms with reasonable care but is not liable for normal wear from handling and display, acts of God, or theft or loss beyond Dealer’s reasonable control, unless Consignor purchases insurance (election and cost recorded on the official in-store copy). Consignor is responsible for maintaining Consignor’s own insurance on the firearms.

5.8  Unclaimed property. Firearms not picked up within 30 days after Dealer gives written notice (to the address, phone, or email provided) that the consignment has ended or that the firearm must be picked up will be handled as abandoned or unclaimed property in accordance with Alabama law.

5.9  Right to refuse a sale. Dealer may refuse or cancel any sale to a buyer who is ineligible, fails the background check, or whom Dealer reasonably believes should not receive the firearm.

5.10  Photographs and online listing. Dealer may photograph the firearms and list them in store and online. Listings will not show any distributor names.

5.11  Governing law; entire agreement. This Contract is governed by the laws of the State of Alabama. It is the entire agreement between the parties and may be changed only in writing signed or initialed by both parties.
