ATF stops enforcing NFA registration for SBRs, SBSs, suppressors and AOWs

ATF NFA guidance effective October 9, 2026

Short answer: Effective October 9, 2026, ATF stopped enforcing NFA approval and registration requirements for short-barreled rifles, short-barreled shotguns, suppressors and "any other weapons." Machine guns and destructive devices are still fully regulated, and federal dealer rules and state laws still apply.

What ATF announced

ATF published an Open Letter and a set of FAQs explaining how it will treat the NFA firearms for which Congress eliminated the making and transfer taxes in the One Big Beautiful Bill Act. The letter follows an August 2026 federal district court injunction in Silencer Shop Foundation v. ATF (N.D. Tex.), which applied only to the plaintiffs. The Department of Justice chose to apply the non-enforcement policy uniformly.

What it covers

  • Short-barreled rifles (SBRs)
  • Short-barreled shotguns (SBSs)
  • Suppressors (silencers)
  • "Any other weapons" (AOWs) as defined in 26 U.S.C. § 5845(e)

For those items, ATF says it will not enforce the prior-approval requirement to make or transfer, the registration requirement in the National Firearms Registration and Transfer Record, or the related tax-stamp requirements. ATF says it will still accept Forms 1, 3 and 4 on a voluntary basis.

What has not changed

  • Machine guns and destructive devices remain fully regulated under the NFA, and the $200 tax remains in place for them.
  • Gun Control Act rules still apply, including prohibited-person restrictions, Form 4473 and NICS checks at licensed dealers, and dealer recordkeeping.
  • State and local laws that restrict NFA items are not superseded by this guidance.
  • ATF's FAQ notes that interstate transport of SBRs and SBSs still involves Form 5320.20. Read the FAQ before traveling.

What it means at our counter

This is an enforcement policy, not a change in the statute, and it is tied to ongoing litigation. If you are thinking about a suppressor or SBR, talk to us before you buy so we can walk through current federal guidance and Alabama law with you. Start with our FFL Transfers page or ask the counter.

FAQ

What changed on October 9, 2026?

ATF said it will no longer enforce the NFA requirements to get approval before making or transferring short-barreled rifles, short-barreled shotguns, suppressors and "any other weapons," or to register them, as applied to those items.

Are machine guns and destructive devices affected?

No. The $200 tax remains for machine guns and destructive devices, and the NFA applies to them in full.

Do I still fill out a Form 4473 at a dealer?

Yes. Gun Control Act requirements, including the Form 4473 and NICS background check at a licensed dealer, still apply, and state and local laws still control.

Not legal advice. Federal, Alabama and local laws apply.
